Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Hivemind platform ("Service") operated by HIVEMIND YT LLC ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part, you may not use the Service.
1. Account Registration
You must be at least 16 years of age to create an account. You are responsible for maintaining the confidentiality of your account credentials and are fully responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use.
You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
2. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law
- Attempt to gain unauthorized access to any part of the Service, other accounts, or connected systems
- Upload, transmit, or distribute any malicious code, viruses, or harmful content
- Interfere with or disrupt the Service, servers, or networks
- Use the Service to infringe on intellectual property rights of third parties
- Reverse engineer, decompile, or disassemble any part of the Service
- Use automated tools (bots, scrapers) to access the Service except through our official API
- Resell, sublicense, or redistribute access to the Service without written consent
- Use the Service to generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Circumvent, disable, or interfere with security features of the Service
3. YouTube API Services
The Service uses the YouTube API Services. By using features that access YouTube data, you are also agreeing to the YouTube Terms of Service and the Google Privacy Policy.
4. Intellectual Property
4.1 Our Content
The Service, including its design, code, algorithms, trademarks, and documentation, is owned by HIVEMIND YT LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our express written consent.
4.2 Your Content
You retain ownership of any content you upload or create using the Service (including Knowledge Bases, Creative Drafts, and portal configurations). By using the Service, you grant us a limited, non-exclusive license to process, store, and display your content solely for the purpose of providing the Service to you.
4.3 AI-Generated Content
Content generated by our AI features (RAG chat responses, analyses, Writers Room output, Sponsor Insights) is provided as-is. You may use AI-generated content for personal and commercial purposes, but you acknowledge that AI output may contain inaccuracies and should be verified independently. See our Disclaimers for details.
5. Subscription and Billing
5.1 Plans and Pricing
The Service offers free and paid subscription tiers. Pricing is as published on the billing page and may change with 30 days notice to active subscribers. Current subscribers will be grandfathered at their existing rate until the end of their current billing cycle.
5.2 Billing
Paid subscriptions are billed in advance on a monthly or annual basis via Stripe. By subscribing, you authorize us to charge your payment method at the applicable rate. Subscriptions automatically renew unless cancelled.
5.3 Cancellation
You may cancel your subscription at any time through the Stripe Customer Portal (accessible from the Billing page). Upon cancellation, your subscription remains active until the end of the current billing period, after which your account reverts to the Synapse (free) tier.
5.4 Refunds
We generally do not offer refunds for subscription fees. However, if you believe you were charged in error or have extenuating circumstances, please contact us at contact@hivemind.yt within 14 days of the charge.
6. Service Availability
We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from Service downtime.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIVEMIND YT LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
8. Indemnification
You agree to indemnify, defend, and hold harmless HIVEMIND YT LLC and its affiliates from any claims, damages, losses, liabilities, costs, and expenses arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you create, upload, or share through the Service.
9. Termination
We may suspend or terminate your account at our sole discretion, without prior notice, for conduct that we believe violates these Terms, is harmful to other users or the Service, or for any other reason. Upon termination, your right to use the Service ceases immediately.
You may delete your account at any time through Account Settings. Upon deletion, your data will be permanently removed within 30 days, except as required by law for compliance purposes.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR VIRUS-FREE.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in the State of Delaware. Each party shall bear its own costs.
You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against HIVEMIND YT LLC.
12. Changes to These Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
