HIVEMIND YT Developer API Terms of Use

1. Introduction and Acceptance

These API Terms of Use (these "API Terms") govern access to and use of the HIVEMIND YT developer API and any associated documentation, software development kits, sample code, credentials, and related materials (collectively, the "API"). The API is operated by HIVEMIND YT LLC, a California limited liability company ("HIVEMIND YT LLC," "we," "us," or "our"), which provides the HIVEMIND YT YouTube creator-growth platform at hivemind.yt (the "Service").

By registering for, accessing, or using the API, or by issuing any request to an API endpoint, you ("you," "your," or "Developer") agree to be bound by these API Terms. If you are accessing the API on behalf of a company or other legal entity, you represent that you have authority to bind that entity, and "you" refers to that entity. If you do not agree to these API Terms, you must not access or use the API.

These API Terms supplement, and are in addition to, the HIVEMIND YT Terms of Service, Privacy Policy, Acceptable Use Policy, and any other agreement between you and HIVEMIND YT LLC that governs your use of the Service. In the event of a conflict between these API Terms and another HIVEMIND YT agreement specifically concerning the API, these API Terms control with respect to the API. You must also comply with all third-party terms referenced in these API Terms, including the Google and YouTube developer policies and the terms of any social platform to which you publish.

Notices to HIVEMIND YT LLC under these API Terms may be sent to contact@hivemind.yt and, where a mailing address is required, to the registered agent on file with the California Secretary of State.

2. Scope of the Developer API

The API is a developer product that allows you to programmatically access certain features and data of the HIVEMIND YT Service in a manner described in the published OpenAPI documentation that HIVEMIND YT LLC makes available. The scope of the API, including the available endpoints, methods, fields, and capabilities, is defined solely by that documentation and by these API Terms.

Your right to use the API is a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to make calls to the API solely to build, operate, and improve your own applications and integrations that interact with the Service, in accordance with these API Terms and all applicable documentation. No ownership in the API, the Service, or any HIVEMIND YT LLC intellectual property is transferred to you. All right, title, and interest in and to the API and the Service, and all related intellectual property, remain with HIVEMIND YT LLC and its licensors. You must not remove or alter any proprietary notices.

Access to the API, and to particular endpoints and data, may depend on your HIVEMIND YT account, your subscription plan, and the permissions and authorizations associated with your account. The HIVEMIND YT product offers subscription tiers (Synapse, Cortex, Nexus, and Omni). During the current private beta, access to the Service, including the API, is provided free of charge under an invite access code, and plans, prices, features, and entitlements are non-final and subject to change at any time. See the Beta and No Service Level Commitment section below.

Some HIVEMIND YT features may allow you to supply your own third-party API keys ("bring your own key" or BYOK), including your own AI or YouTube API keys, stored in session, device, or account modes. Any keys you supply are your responsibility, including their security, their permitted use, and any charges or obligations associated with them under the applicable third-party provider's terms. HIVEMIND YT LLC is not responsible for your use of, or any consequences arising from, keys you supply.

3. Eligibility and Account Requirements

To use the API you must have a valid HIVEMIND YT account in good standing and, during the beta period, a valid invite access code. You are responsible for maintaining the accuracy of your account and developer registration information.

The Service is not directed to, and you may not use the API to provide the Service to, anyone under the age of 18. You must not use the API in any manner that would cause HIVEMIND YT LLC to collect personal information from anyone under 18.

Where the API exposes features that connect to YouTube or other Google services, or that publish to third-party social platforms, your access to and use of those features is conditioned on your and your end users' acceptance of the HIVEMIND YT Privacy Policy and the applicable third-party terms, and on valid authorization (including OAuth where required) for each connected account.

4. Authentication and API Keys

Access to the API requires authentication using the credentials, API keys, tokens, or other access mechanisms that HIVEMIND YT LLC issues or makes available to you (collectively, "Credentials"). Credentials are confidential, are issued to you for your use only, and may not be shared, sold, transferred, sublicensed, or otherwise disclosed to any third party.

You must keep your Credentials secret and secure. You are solely responsible for safeguarding your Credentials and for all activity that occurs under them, whether or not authorized by you. You must use commercially reasonable measures to protect your Credentials, including secure storage, restricted access, and rotation where appropriate. You must not embed Credentials in client-side code, public repositories, or any location where they may be exposed to unauthorized parties.

You must promptly notify HIVEMIND YT LLC at contact@hivemind.yt if you know or suspect that your Credentials have been lost, stolen, compromised, or used without authorization. HIVEMIND YT LLC may reset, revoke, or reissue Credentials at any time, including in response to suspected compromise or violation of these API Terms.

You must not attempt to access the API by any means other than the Credentials and interfaces that HIVEMIND YT LLC provides, and you must not circumvent, disable, or interfere with any authentication, authorization, or security mechanism of the API.

5. Rate Limits and Fair Use

The API is subject to rate limits, quotas, and other usage limitations that HIVEMIND YT LLC may establish, publish, or modify from time to time. These limits exist to protect the stability, security, performance, and availability of the Service for all users. You must design your applications to respect all applicable rate limits and to handle throttling, error, and back-off responses gracefully.

You must use the API in a manner consistent with fair use and must not impose an unreasonable or disproportionate load on the Service. You must not exceed, evade, or circumvent any rate limit, quota, or access limitation, including by using multiple accounts or Credentials, by distributing requests across identities, or by any other technique intended to obtain access beyond your authorized limits.

HIVEMIND YT LLC may, in its discretion, throttle, queue, suspend, or limit your API access where your usage exceeds applicable limits, threatens the integrity or availability of the Service, or otherwise violates these API Terms. HIVEMIND YT LLC may also impose new or revised limits at any time.

6. Prohibited Uses of the API

You must not use the API, or any data or content obtained through the API, to do any of the following, and you must not enable or assist any third party to do so:

(a) Reselling, redistributing, sublicensing, or otherwise transferring raw data obtained from the API to any third party, or selling, licensing, or commercializing such data outside of your authorized application and integration.

(b) Building, training, augmenting, or populating a competing index, dataset, database, search service, foundation model, or other product or service that replicates, competes with, or substitutes for the Service or any HIVEMIND YT feature, or aggregating API data into any such index or dataset.

(c) Scraping, crawling, spidering, harvesting, or otherwise systematically extracting or collecting data from the Service or from any platform reached through the Service, other than through the documented and authorized API endpoints.

(d) Exceeding, evading, or circumventing rate limits, quotas, access controls, authentication, or other access limitations of the API, or attempting to gain unauthorized access to the API, the Service, or any systems or networks connected to them.

(e) Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code, structure, or underlying ideas of the API or the Service, except to the extent this restriction is prohibited by applicable law.

(f) Re-identifying, de-anonymizing, or attempting to reverse engineer any anonymized, aggregated, or pseudonymized data obtained through the API, or combining API data with other data to build or augment profiles of individuals without valid consent.

(g) Using the API or any data obtained through it to train artificial intelligence or machine learning models, except to the extent expressly permitted in writing by HIVEMIND YT LLC and, where applicable, by the originating third-party platform.

(h) Using the API in any manner that violates any applicable law or regulation, infringes any intellectual property or other right of any person, or violates the HIVEMIND YT Terms of Service, Acceptable Use Policy, or any third-party terms referenced in these API Terms.

(i) Interfering with, disrupting, degrading, or imposing an unreasonable load on the API or the Service, including by transmitting malware, launching denial-of-service activity, or probing or testing the vulnerability of any system without authorization.

(j) Uploading, submitting, or transmitting through the API any content that infringes copyright or other rights, or that was obtained by circumventing technological protection measures. The Service relies exclusively on official Google and YouTube APIs for YouTube data and analytics, and does not perform stream-ripping or use unauthorized scrapers or stream-downloaders. You must not use the API to facilitate stream-ripping or any circumvention of access controls or technological protection measures on any platform.

7. Google and YouTube Data Obtained Through the API

The Service incorporates Google and YouTube API Services, including the YouTube Data API v3 and the YouTube Analytics API, and uses Google Sign-In and OAuth. Any data that you access, receive, or derive through the API that originates from YouTube, Google, or any Google API Service ("Google Data") is subject to, and you must comply with, the applicable Google and YouTube developer terms and policies, in addition to these API Terms.

By using the API to access or handle Google Data, you agree to be bound by the YouTube Terms of Service, available at https://www.youtube.com/t/terms. You also acknowledge that the Service and your use of Google Data are subject to the YouTube API Services Terms of Service, available at https://developers.google.com/youtube/terms/api-services-terms-of-service, the YouTube API Services Developer Policies, available at https://developers.google.com/youtube/terms/developer-policies, and the Google API Services User Data Policy, available at https://developers.google.com/terms/api-services-user-data-policy. Google's Privacy Policy, available at https://www.google.com/policies/privacy/, governs personal data provided to or processed by Google in connection with the YouTube API Services.

Your access to and use of Google Data through the API must adhere to the Google API Services User Data Policy, including the Limited Use requirements. You must not transfer or sell Google Data to third parties such as advertising platforms, data brokers, or information resellers; you must not use Google Data to serve advertising, including retargeting, personalized, or interest-based advertising; and you must use Google Data only to provide or improve user-facing features, consistent with the scopes that the user has authorized.

Where the Service or your integration enables uploading content to YouTube on a user's behalf, the uploading user must certify, and you must ensure your application reflects, that the uploaded content complies with the YouTube Terms of Service, including the YouTube Community Guidelines, available at https://www.youtube.com/t/terms. You must not use the API to perform actions on a user's YouTube account beyond what the user has authorized.

You acknowledge that Google and YouTube may impose, change, limit, suspend, or terminate access to their API Services at any time, and that HIVEMIND YT LLC is not responsible or liable for any such change, limitation, suspension, or termination by Google or YouTube. Your access to Google Data through the API is contingent on continued access to, and compliance with, the Google and YouTube API Services.

Separately, the Service offers a Creator API through which a creator may expose data derived from their own channel to third parties that the creator authorizes with a creator key. When you consume the Creator API, you may access the creator's data only in accordance with the scope the creator has consented to expose and only for so long as that consent remains in effect. Where the Creator API returns a link that is marked as an affiliate or commission link together with a disclosure text, you must display that disclosure text clearly and immediately adjacent to the link wherever you surface it, so that the material connection is conveyed to the end user, consistent with the United States Federal Trade Commission's guidance on endorsements at 16 C.F.R. Part 255. You must attribute content to its source, must not present Creator API data as your own original reporting, and must not use the Creator API to reconstruct, substitute for, or scrape YouTube or Google services.

8. Publishing to Social Platforms

Where the API or the Service enables publishing or scheduling content to third-party social platforms (which may include Meta, Instagram, Threads, Facebook, TikTok, X (formerly Twitter), and LinkedIn), HIVEMIND YT LLC publishes such content only on the user's behalf and at the user's direction, and only after the user has validly authorized the relevant account (including OAuth where required) and has reviewed and approved the specific content for publication. The user retains responsibility for the content they create and choose to publish.

You and your end users must comply with the terms, developer policies, automation rules, content standards, display requirements, and brand guidelines of each destination platform to which content is published. By using the API to publish, you agree to those platform terms and incorporate them by reference, and you must require your own end users to comply with them.

You and your end users must hold all rights, consents, permissions, and licenses necessary for any content submitted for publication. You and your end users must not use the API or the Service to send spam, engage in platform manipulation, post identical or substantially similar content across multiple accounts, or perform bulk, aggressive, or automated actions that violate a destination platform's automation rules. You and your end users must not publish content that a destination platform's content standards or community guidelines prohibit. You and your end users must not superimpose or add any brand name, logo, watermark, or promotional branding onto content submitted for publication except where the destination platform expressly permits it in writing.

Your access to and ability to publish through any platform API is subject to that platform's own terms and may be rate-limited, throttled, suspended, or terminated by the platform at any time. HIVEMIND YT LLC passes these constraints through to you and your end users and is not responsible or liable for any platform's availability, accuracy, security, content moderation, suspensions, account terminations, data loss, or downtime. Each user's relationship with a destination platform is governed by that platform's own terms directly between the user and that platform.

The names, logos, and marks of Meta, Facebook, Instagram, Threads, TikTok, X, LinkedIn, and any other platform are the property of their respective owners. Any use of a platform's brand features is permitted only under the limited license that the platform grants and only to identify the integration or the source of content. Neither you nor your end users may claim or imply any endorsement, sponsorship, partnership, or affiliation with any platform.

HIVEMIND YT LLC may suspend or terminate your or your end users' access to publishing features, and may remove or refuse to publish content, where required to comply with a platform's terms or a platform's enforcement request, and may require you to cooperate with audits or proof-of-compliance demands that a platform passes through.

9. Suspension and Termination for Abuse

HIVEMIND YT LLC may suspend, throttle, restrict, or terminate your access to the API, and may revoke your Credentials, at any time, with or without notice, if HIVEMIND YT LLC reasonably determines that: you have violated these API Terms or any other HIVEMIND YT agreement or applicable third-party terms; your use threatens the security, integrity, performance, or availability of the Service; your use is abusive, fraudulent, or unlawful; you have exceeded or circumvented rate limits or access controls; or suspension or termination is required to comply with law, with a third-party platform's terms, or with a platform's enforcement or compliance request.

HIVEMIND YT LLC may also suspend or terminate API access where Google, YouTube, or a destination social platform requires it, or where access to a third-party API on which a feature depends is changed, limited, suspended, or terminated by the third party.

Upon suspension or termination of your API access, you must immediately cease all use of the API and of any data obtained through it, except as required to comply with your retention and deletion obligations, and you must delete data as required by these API Terms, the applicable third-party policies, and the HIVEMIND YT Privacy Policy. Provisions that by their nature should survive termination, including the sections on intellectual property, prohibited uses, data obligations, disclaimers, limitation of liability, indemnification, and governing law and dispute resolution, will survive.

10. Data Handling, Retention, and Deletion

You must handle all data obtained through the API in accordance with these API Terms, the HIVEMIND YT Privacy Policy, the Google API Services User Data Policy (including Limited Use), and the YouTube API Services Developer Policies. You must require your end users to agree to a privacy policy before they can access features that handle their data, and you must maintain your own published privacy policy that accurately discloses how you access, collect, store, use, and share data.

For authorized YouTube data, the Service refreshes or deletes stored data within 30 days, and stored authorized data is kept only as long as necessary for the user's active, granted consent. If a user requests deletion or authorization can no longer be verified, the data is deleted within 30 days. You must implement equivalent refresh-or-delete and deletion-on-request practices for any authorized YouTube data you store through your integration. Users may revoke an application's access to their data at any time via the Google security settings page at https://security.google.com/settings/security/permissions.

Certain records that HIVEMIND YT LLC must retain for legal, financial, tax, audit, or compliance purposes (for example, payment, ledger, and tax records) are pseudonymized rather than deleted upon an erasure request, while user-facing fields are erased. Payments are processed by Stripe; HIVEMIND YT LLC does not store full card numbers. The Service provides a data export capability.

11. AI-Generated Content Through the API

Certain HIVEMIND YT features accessible through or related to the API use generative artificial intelligence, including Google Gemini and Vertex AI. Any AI-generated content produced through the Service is generated algorithmically, is not human-reviewed, and may be inaccurate, incomplete, or unsuitable for a particular purpose. AI-generated content is provided without warranty and does not constitute professional, legal, medical, or financial advice. You must independently verify AI-generated outputs before relying on them, and HIVEMIND YT LLC makes no guarantee of any growth, revenue, or other results.

Material generated purely by artificial intelligence, with no sufficient human creative contribution, may not be eligible for copyright protection in the United States, and the mere provision of prompts does not by itself create a copyrightable work. You are responsible for determining the ownership and permissible use of any AI-generated outputs you obtain through the API and for disclosing, where appropriate, that content was produced or assisted by generative artificial intelligence.

12. No Warranty

The API is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted under California law, HIVEMIND YT LLC disclaims all warranties, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising from course of dealing or usage of trade.

HIVEMIND YT LLC does not warrant that the API will be uninterrupted, timely, secure, error-free, or free of harmful components, or that any data obtained through the API will be accurate, complete, or reliable. The third-party platforms and their APIs (including Google, YouTube, and the social platforms) are likewise provided on an as-is and as-available basis, and HIVEMIND YT LLC does not control and is not responsible for their availability, accuracy, completeness, security, or uninterrupted operation.

13. Beta and No Service Level Commitment

The Service, including the API, is currently offered in a private beta. The API and related features are pre-release, may be incomplete, may contain bugs or errors, and may produce unexpected results. Features, pricing, plans, endpoints, fields, and behavior are subject to change at any time in HIVEMIND YT LLC's sole discretion, with or without notice. You should not rely on the beta API for production use or for storing important data, and data created or stored during the beta period may be deleted, reset, or not migrated.

During the beta, HIVEMIND YT LLC provides no service level agreement, uptime commitment, or support commitment of any kind for the API. HIVEMIND YT LLC has no obligation to release any generally available version of the API or to maintain or continue any feature.

14. Changes to the API and to These Terms

HIVEMIND YT LLC may modify, update, suspend, deprecate, or discontinue the API, any endpoint, any data field, or any feature, in whole or in part, at any time, with or without notice. HIVEMIND YT LLC may also modify rate limits, quotas, documentation, and other usage requirements at any time.

HIVEMIND YT LLC may revise these API Terms from time to time. Revised terms become effective when posted or otherwise made available, or as otherwise stated in the revision. Your continued access to or use of the API after revised API Terms take effect constitutes your acceptance of the revised API Terms. If you do not agree to a revision, you must stop using the API.

15. Limitation of Liability and Indemnification

To the fullest extent permitted under California law, HIVEMIND YT LLC will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or relating to the API or these API Terms, whether based in contract, tort, or any other legal theory, even if HIVEMIND YT LLC has been advised of the possibility of such damages. HIVEMIND YT LLC is not liable for the acts, decisions, content moderation, suspensions, account terminations, data loss, or downtime of any third-party platform.

You agree to defend, indemnify, and hold harmless HIVEMIND YT LLC and its members, officers, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use or misuse of the API, your content, your violation of these API Terms or any applicable law, your violation of any third-party terms (including the Google, YouTube, and social platform terms), or your infringement of any right of any person.

16. Governing Law and Dispute Resolution

These API Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-laws principles.

Any dispute arising out of or relating to these API Terms or the API will be resolved by binding arbitration administered under the Commercial Arbitration Rules of the American Arbitration Association, with venue in California. You and HIVEMIND YT LLC waive any right to participate in a class action or class-wide arbitration. This dispute resolution provision is subject to and consistent with the dispute resolution terms of the HIVEMIND YT Terms of Service.
