Introduction
This Refund Policy (the "Policy") explains how HIVEMIND YT LLC, a California limited liability company ("HIVEMIND YT LLC," "HIVEMIND YT," "we," "us," or "our"), handles payments, cancellations, and refunds for the HIVEMIND YT service available at hivemind.yt (the "Service"). It applies to all paid subscription plans offered through the Service, including the Synapse, Cortex, Nexus, and Omni tiers, whether billed monthly or annually.
This Policy forms part of, and should be read together with, our Terms of Service. Capitalized terms that are not defined here have the meaning given to them in the Terms of Service. By purchasing or using a paid plan, you agree to the terms of this Policy. To the extent this Policy conflicts with a mandatory consumer-protection law that applies to you, that law controls, and nothing in this Policy waives or limits any statutory right that cannot be waived under the law that applies to you.
Payments for the Service are processed by Stripe, our third-party payment processor. HIVEMIND YT LLC does not store full payment card numbers; card data is handled by Stripe under its own terms and security standards. Amounts are charged in United States dollars.
1. General Refund Stance
Except as expressly stated in this Policy or as required by applicable law, all fees paid for the Service are non-refundable. This includes subscription fees for any monthly or annual plan, fees for any partial billing period, and amounts already charged for a billing period that is in progress. We do not provide refunds or credits for periods during which your account remained open but you did not use the Service, for features you chose not to use, or for dissatisfaction with results, given the nature of the Service as described in our Disclaimers.
Because the Service is delivered as digital content and online software that is made available to you immediately, fees are generally considered earned when the corresponding billing period begins and access is provided. The statutory rights described in Section 6 are preserved and are not affected by this general stance.
Charges incurred under your own API keys are outside this Policy. Where you supply your own third-party artificial-intelligence or platform credentials ("BYOK"), the provider that issued those credentials bills you directly for the work performed under them. Those amounts are not fees paid to HIVEMIND YT LLC, are not part of any subscription price, and are not covered by this Policy: we do not refund, credit, offset, or reimburse them, whatever the cause, and we cannot reverse a charge made on an account we do not hold. This applies to a run you did not intend, a run that failed or produced an unusable result, a repeated or retried operation, and any charge arising from a credential that was shared, leaked, or used by another person. Section 7 of the Terms of Service at /legal/terms describes which features run on your own credentials and which run on ours. Nothing in this paragraph limits any right you have against your own provider, or any statutory right described in Section 6.
2. Billing-Error Window (14 Days)
If you believe you have been charged in error (for example, a duplicate charge, an incorrect amount, a charge after a valid cancellation, or a charge you did not authorize), you must contact us at contact@hivemind.yt within fourteen (14) calendar days of the date the charge appears on your account or payment statement.
Please include your account email, the approximate date and amount of the charge, and a short description of the issue so we can locate and review the transaction. If we determine that a billing error occurred, we will correct it, which may include issuing a refund or credit for the amount charged in error, processed back to your original payment method through Stripe. Submitting a billing-error request within this window does not, by itself, change the general non-refundable nature of correctly billed subscription fees described in Section 1.
3. Cancellation and No Proration
You may cancel a paid subscription at any time. Cancellation takes effect at the end of your then-current billing period (the monthly or annual period you have already paid for). Until that period ends, you retain access to the paid features included in your plan, and your subscription will not renew for the following period once you have cancelled.
Cancelling a subscription stops future renewal charges but does not, by itself, generate a refund for the current period. Except where required by applicable law, we do not prorate or refund fees for the unused portion of a billing period that has already begun. If you cancel an annual plan after it has renewed, you keep access through the end of that annual term, and the fee for that term is not prorated or refunded except as required by law or as otherwise stated in this Policy.
If you accepted an automatically renewing offer, you may cancel online through your account, or by contacting us at contact@hivemind.yt, using a method at least as easy to use as the method by which you signed up, consistent with applicable automatic-renewal laws. To avoid a renewal charge, please cancel before the start of the next billing period.
4. Chargebacks
If you have a concern about a charge, please contact us first at contact@hivemind.yt so we can investigate and, where appropriate, resolve it directly. Many issues, including suspected billing errors, can be addressed more quickly by contacting us than by disputing a charge with your bank or card issuer.
Initiating a chargeback or payment dispute for a charge that is valid under this Policy and the Terms of Service, instead of using the contact and billing-error processes above, may be treated as a breach of the Terms of Service. In response to a chargeback on validly billed amounts, we may suspend or terminate your access to the Service and any associated accounts, and we may decline to provide further access until the disputed amount is resolved. We reserve the right to submit transaction records and related information to Stripe and the relevant card network to contest a chargeback that we believe is not justified. This Section does not limit any chargeback or dispute right you have under applicable law or your card network's rules.
5. Beta Access
The Service is currently offered through a private beta available by invitation using an access code. During the beta period, access to the Service is provided free of charge, and paid plans and their features are generally not charged. Plans, prices, and features shown in the product during beta are pre-release and are subject to change at any time, with or without notice, in our sole discretion, and do not represent a final or guaranteed offering.
Because paid features are generally not charged during the beta, there is typically nothing to refund for beta access. If, despite the foregoing, you are charged a fee during the beta that you believe is incorrect, please contact us under Section 2 (Billing-Error Window) and we will review it. Your statutory rights described in Section 6 continue to apply to any amount you are actually charged.
6. Statutory Consumer Rights (EU and UK Withdrawal)
Nothing in this Policy limits or excludes any rights you have under mandatory consumer-protection laws that apply to you. The following rights apply to consumers in the European Union and the United Kingdom and are preserved regardless of the general stance in Section 1.
If you are a consumer in the European Union, you generally have a right under the Consumer Rights Directive (2011/83/EU) to withdraw from a purchase of digital content or services made at a distance within fourteen (14) days, without giving a reason. If you are a consumer in the United Kingdom, you generally have an equivalent fourteen (14) day cancellation right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Immediate-performance waiver and acknowledgment: where the Service is supplied as digital content or as a digital service that begins immediately, you may be asked, before performance begins, to give your prior express consent to begin performance during the 14-day period and to acknowledge that you will lose your right of withdrawal or cancellation once performance has begun. If you give that consent and acknowledgment and we begin supplying the Service, your statutory right to withdraw or cancel is lost to the extent permitted by law. If you have not given that consent, or if the required information was not provided to you, your withdrawal or cancellation right continues to apply as provided by the applicable law, and your cancellation period may be extended as that law provides.
To exercise an applicable withdrawal or cancellation right within the 14-day window, contact us at contact@hivemind.yt with your account email and a clear statement that you wish to withdraw from or cancel your purchase. Where a refund is due under the applicable law, we will process it to your original payment method without undue delay and within the period required by that law.
7. How to Request a Refund or Raise a Billing Issue
To request a refund, report a billing error, or exercise a statutory cancellation right, contact us at contact@hivemind.yt. Please include: (a) the email address associated with your account; (b) the approximate date and amount of the charge; (c) the plan or item involved; and (d) a brief description of your request or the issue.
We review refund and billing requests on a case-by-case basis in accordance with this Policy and applicable law. Approved refunds are issued to your original payment method through Stripe; the time for the refund to appear depends on Stripe and your card issuer or bank. We may ask you for additional information reasonably necessary to verify your account and the transaction before processing a request.
8. Changes to This Policy
We may update this Refund Policy from time to time. When we make changes, we will revise the "Last updated" date at the top of this Policy and post the updated version through the Service. Changes apply prospectively to purchases and billing periods that begin after the updated Policy takes effect, except where applicable law requires otherwise. Your continued use of the Service or renewal of a subscription after an update means you accept the updated Policy.
