1. Introduction and Scope

These Disclaimers govern your use of HIVEMIND YT, a YouTube creator-growth platform operated by HIVEMIND YT LLC, a California limited liability company (HIVEMIND YT LLC, we, us, or our). HIVEMIND YT is accessible at hivemind.yt and includes features such as Pulse Analytics, Create Clips, Knowledge Bases and Video Intelligence, Community Portals, an administrative console, subscription-based monetization, and a public developer API.

These Disclaimers supplement, and are incorporated by reference into, our Terms of Service, Privacy Policy, Acceptable Use Policy, and other posted legal documents. To the extent any conflict exists between these Disclaimers and a more specific provision in another legal document, the more specific provision controls for the subject it addresses. Capitalized terms not defined here have the meaning given in the Terms of Service.

By accessing or using HIVEMIND YT, you acknowledge that you have read, understood, and agreed to these Disclaimers. If you do not agree, you must not access or use the service. These Disclaimers apply to the maximum extent permitted by applicable law and are governed by the laws of the State of California, without regard to its conflict-of-laws rules, as further described in our Terms of Service.

2. AI-Generated Content Is Algorithmic and Not Human-Reviewed

HIVEMIND YT uses artificial intelligence and machine learning systems, including Google Gemini and Vertex AI and other automated technologies, to produce outputs such as video and channel analysis, sponsor insights, clip suggestions, generated titles, descriptions, captions, summaries, and other analytical or generative content (collectively, AI Output). AI Output is produced algorithmically by automated systems. It is not reviewed, verified, edited, or approved by a human before it is presented to you unless we expressly state otherwise.

AI Output may be inaccurate, incomplete, outdated, misleading, or unsuitable for your particular purpose, and it may produce unexpected results. Generative AI systems can produce content that appears authoritative but is factually wrong, including fabricated facts, figures, statistics, recommendations, or assertions. You are solely responsible for reviewing, verifying, and independently confirming any AI Output before relying on it or acting on it. You should not rely on AI Output as your sole basis for any decision.

Where reasonably feasible, HIVEMIND YT labels or otherwise indicates content that is generated or assisted by generative artificial intelligence so that you are informed of its nature. The absence of a label does not mean a given output was human-reviewed, and you should treat all analytical and generative output as algorithmically produced unless we expressly tell you it was human-verified.

AI Output is provided on an as-is and as-available basis, without warranties of any kind, to the maximum extent permitted under California law. We do not warrant that AI Output will be accurate, reliable, complete, current, error-free, or fit for any particular purpose.

3. No Professional, Financial, Legal, or Other Advice

HIVEMIND YT, including all AI Output, analytics, dashboards, insights, recommendations, and other content, is provided for general informational and operational purposes only. It does not constitute, and must not be relied upon as, professional, financial, investment, accounting, tax, legal, medical, or other regulated advice.

No content provided through HIVEMIND YT creates any professional or advisory relationship between you and HIVEMIND YT LLC. We are not your attorney, accountant, financial advisor, tax advisor, or other professional adviser, and nothing in the service should be construed as such. Before making any decision that may have legal, financial, tax, or other significant consequences, you should consult a qualified professional licensed in your jurisdiction who can consider your specific circumstances.

Any decisions you make, and any actions you take or refrain from taking, based on HIVEMIND YT or its content are made at your own discretion and risk. To the maximum extent permitted by applicable law, HIVEMIND YT LLC disclaims all liability for decisions or actions taken in reliance on the service or its content.

4. No Guarantee of Growth, Revenue, or Results

HIVEMIND YT is a tool intended to assist creators with analytics, content creation, knowledge management, and publishing workflows. We make no representation, warranty, or guarantee of any kind that using HIVEMIND YT will increase your audience, subscribers, views, watch time, engagement, followers, revenue, monetization, brand deals, sponsorships, search ranking, or any other outcome, or that it will produce any specific result at all.

Any examples, projections, estimates, forecasts, benchmarks, or illustrations of potential outcomes that may appear in the service or in our materials are hypothetical and for illustration only. They are not promises or guarantees of performance. Your results depend on many factors outside our control, including the quality and nature of your content, your niche and audience, market conditions, the policies and algorithms of third-party platforms such as YouTube and the social platforms to which you publish, and your own efforts and decisions.

Past performance, sample data, and any case studies or testimonials are not indicative of future results and are not a guarantee that you will achieve similar outcomes. You assume all risk associated with your use of HIVEMIND YT and your creator activities.

5. Third-Party Content, Platforms, and Services

HIVEMIND YT integrates with and relies on third-party services and platforms, including Google Sign-In and OAuth, the YouTube Data API and YouTube Analytics API, Google Gemini and Vertex AI, Firebase and Google Cloud, Firecrawl for certain web retrieval, Stripe and Stripe Connect for payments and affiliate payouts, and social publishing targets including Meta, Instagram, Threads, Facebook, TikTok, X (Twitter), and LinkedIn. These third-party services and any content retrieved from or delivered through them are provided by their respective operators and are outside our control.

Third-party services, their application programming interfaces, and any data, content, availability, or functionality they provide are made available to you on an as-is and as-available basis. We do not control and are not responsible for the availability, accuracy, completeness, security, legality, timeliness, or uninterrupted operation of any third-party service or any content it supplies, and we disclaim all warranties relating to them to the maximum extent permitted under California law.

Your access to and ability to publish through, or retrieve data from, any third-party platform is subject to that platform's own terms, and may be rate-limited, throttled, suspended, modified, or terminated by the platform at any time, with or without notice. We pass those constraints through to you and are not liable for them. We are not responsible for the acts, omissions, decisions, content-moderation actions, account suspensions or terminations, data loss, downtime, or policy changes of any third-party platform. Your relationship with each third-party platform is governed by that platform's own terms directly between you and that platform.

Content that is created, submitted, retrieved, or published through HIVEMIND YT, including content you direct us to publish to social platforms on your behalf, is your responsibility. You are responsible for ensuring that you hold all rights, consents, permissions, and licenses necessary for your content and for complying with the rules of any destination platform to which you publish.

6. Trademarks, Brand Features, and No Endorsement or Affiliation

HIVEMIND YT LLC and HIVEMIND YT are independent and are not endorsed by, sponsored by, affiliated with, or partnered with Google, YouTube, X (Twitter), Meta, Facebook, Instagram, Threads, TikTok, LinkedIn, or any other third-party platform, except to the extent of any limited integration license a platform expressly grants. Any reference to a third-party platform is solely to identify that platform or to identify it as the source of content provided through it.

YouTube and Google, and their respective logos and marks, are trademarks of Google LLC. X (Twitter), Meta, Facebook, Instagram, Threads, TikTok, and LinkedIn, and their respective names, logos, and marks, are the property of their respective owners. All other product names, logos, and brands referenced in HIVEMIND YT are the property of their respective owners and are used only for identification purposes. Use of a third-party name or mark does not imply any endorsement, sponsorship, partnership, or affiliation.

We use each platform's brand features only under the limited license, if any, that the platform grants, and only to identify the integration or to identify the platform as the source of its content. You must not use any third-party platform's name, logo, or marks in a way that implies any endorsement, sponsorship, partnership, or affiliation with that platform, and you must not superimpose or add any brand name, logo, watermark, or promotional branding onto content you submit for publication except where the destination platform expressly permits it in writing.

Where HIVEMIND YT displays content from a third-party platform back to you, we commit to following that platform's display and brand requirements, including X's Display Requirements, which call for displaying real and unmodified posts from real accounts, keeping the platform's logo and the required attribution elements visible, not modifying post content, not using mock-ups of posts that do not exist, and not using such content to imply sponsorship or false association.

7. Ownership of AI-Generated Outputs

Under United States copyright law, material that is generated purely by artificial intelligence, without sufficient human creative contribution, is not eligible for copyright protection, and the mere provision of prompts does not by itself create a copyrightable work. As a result, some or all AI Output you obtain through HIVEMIND YT may not be protectable by copyright in the United States, and we make no representation that any AI Output is owned by, or can be exclusively claimed by, you or any other person.

You are responsible for determining whether and how you may use AI Output, including for confirming that your use does not infringe the rights of any third party. We do not provide legal advice regarding the ownership, registrability, or permissible use of AI Output, and you should consult a qualified attorney about your specific situation.

8. User Content, Uploads, and No Stream-Ripping

You are solely responsible for the media and other content you upload, submit, or direct HIVEMIND YT to process or publish. You represent that you own or otherwise hold all rights, consents, and permissions necessary for that content. Our analytics and knowledge-base features access YouTube data exclusively through official Google and YouTube application programming interfaces. HIVEMIND YT does not employ scrapers or stream-ripping tools to obtain protected YouTube streams, and it does not circumvent technological protection measures or access controls.

When you upload content to YouTube through HIVEMIND YT using authorized YouTube functionality, you certify at the time of upload that the uploaded content complies with the YouTube Terms of Service, including the YouTube Community Guidelines, available at https://www.youtube.com/t/terms. You must not use HIVEMIND YT to upload, submit, or publish content that infringes any copyright or other right, or that was obtained by circumventing any technological protection measure. Circumventing access controls can be a separate legal violation independent of any analysis of the resulting content. We reserve the right to remove such content and to suspend or terminate offending accounts.

9. Forward-Looking Statements and Beta Nature of the Service

HIVEMIND YT is currently offered as a private beta accessible by invitation code. Beta and early-access features are pre-release. They may be incomplete, may contain bugs or errors, and may produce unexpected results, including loss of content or data. The beta service is provided on an as-is and as-available basis, without warranties of any kind, express, implied, or statutory, to the maximum extent permitted under California law. You should not rely on the beta service for production use or for storing important data, and data created or stored during the beta period may be deleted, reset, or not migrated.

Features, functionality, plans, and pricing described in HIVEMIND YT, including the Synapse, Cortex, Nexus, and Omni subscription tiers and the affiliate program, are non-final and subject to change at any time, in our sole discretion, with or without notice. During the beta period, access is provided free of charge. Pre-release pricing and feature changes are expected conditions of the program and are not representations or guarantees of future pricing or availability.

Statements about HIVEMIND YT that are not statements of present fact, including descriptions of planned features, roadmaps, integrations, capabilities, or future availability, are forward-looking statements. Forward-looking statements involve risks and uncertainties, and actual outcomes may differ materially. We have no obligation to release any generally available version of any feature, or to maintain, continue, or support any feature, and we may modify or discontinue any part of the service at any time. We undertake no obligation to update forward-looking statements except as required by law.

10. As-Is and As-Available; Disclaimer of Warranties

Except as expressly stated in a separate written agreement signed by HIVEMIND YT LLC, HIVEMIND YT, including all features, AI Output, analytics, content, and integrations, is provided on an as-is and as-available basis, without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted under California law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and any warranties arising from course of dealing or usage of trade.

We do not warrant that HIVEMIND YT will be uninterrupted, secure, error-free, or free of harmful components, that defects will be corrected, or that any content or output will be accurate or reliable. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you; in that case, such warranties are limited to the minimum scope and duration permitted by applicable law. This Section does not limit any non-waivable statutory rights you may have as a consumer.
