HIVEMIND YT Acceptable Use Policy

1. Introduction and Purpose

This Acceptable Use Policy (the AUP or this Policy) governs your access to and use of HIVEMIND YT, a YouTube creator-growth software-as-a-service platform operated by HIVEMIND YT LLC, a California limited liability company (HIVEMIND YT LLC, we, us, or our), available at hivemind.yt and through any associated applications, programming interfaces, and services (collectively, the Service).

The purpose of this Policy is to define what constitutes acceptable and unacceptable use of the Service, to protect HIVEMIND YT LLC, our users, the creators and communities we serve, and the third-party platforms and providers we integrate with, and to keep the Service safe, lawful, and reliable. This Policy promotes responsible use of features including Pulse Analytics, Create Clips, Knowledge Bases and Video Intelligence, Community Portals, the Admin console, subscription and monetization features, the affiliate program, and the public developer API.

This Policy is incorporated by reference into, and forms a part of, the agreement between you and HIVEMIND YT LLC governing the Service. Capitalized terms not defined here have the meaning given in our Terms of Service. If there is a conflict between this Policy and the Terms of Service regarding permitted conduct, the more restrictive provision controls. By accessing or using the Service, you agree to comply with this Policy. If you do not agree, you must not access or use the Service.

The Service is currently offered in a private beta through an invitation access code. Access during the beta period is provided free of charge; subscription plans, pricing, and features described in the product are pre-release and subject to change at any time. This Policy applies in full during the beta period and thereafter. The Service is not intended for, and may not be used by, anyone under the age of 18.

2. Who This Policy Applies To

This Policy applies to every person and entity that accesses or uses the Service in any capacity, including account holders, authorized users, beta participants, affiliates enrolled in our affiliate program, developers who use our public developer API, and any person acting on your behalf or using credentials issued to you. You are responsible for ensuring that anyone who uses the Service through your account complies with this Policy, and for all activity that occurs under your account or credentials.

Because the Service connects to and acts upon third-party platforms at your direction, including YouTube and the social publishing destinations described below, your use of the Service is also subject to the applicable terms and content rules of those platforms. You agree to comply with all such third-party terms and rules, and you acknowledge that a violation of a connected platform's rules through the Service is also a violation of this Policy.

3. Prohibited Content

You must not use the Service to upload, submit, store, generate, publish, transmit, link to, or otherwise make available any content that falls within the categories below. This list is illustrative and not exhaustive; conduct that is harmful, abusive, or unlawful is prohibited even if not specifically listed.

Zero-tolerance for child sexual abuse material (CSAM): We maintain an absolute, zero-tolerance prohibition on any content that sexually exploits, abuses, or endangers children, including child sexual abuse material in any form, content that sexualizes minors, and any attempt to solicit, produce, distribute, access, or facilitate access to such material. There is no exception to this prohibition. We will remove such content, terminate the responsible accounts immediately and without notice, preserve relevant records as permitted or required by law, and report such material and the associated account information to the National Center for Missing and Exploited Children (NCMEC) and to law enforcement authorities as required by applicable law.

Illegal content: Content that is illegal under applicable federal, state, or local law, or that promotes, facilitates, or provides instructions for illegal activity, including unlawful weapons or controlled substances, human trafficking, terrorism or violent extremism, or the sale of goods or services to persons who may not lawfully receive them (including the sale of tobacco or alcohol to minors).

Intellectual property infringement: Content that infringes the copyright, trademark, patent, trade secret, publicity, privacy, or other rights of any person or entity, including content you do not own or are not authorized to use, and content that uses another party's name, logo, mark, or brand without authorization. Copyright complaints are handled under our separate Digital Millennium Copyright Act (DMCA) notice-and-takedown process; HIVEMIND YT LLC maintains a repeat-infringer policy and will, in appropriate circumstances, terminate the accounts of users who repeatedly infringe.

Content obtained by circumventing technological protection measures: Content that was captured, downloaded, ripped, or otherwise obtained by circumventing access controls or technological protection measures, including content obtained by stream-ripping or by bypassing a platform's encryption, rolling cipher, or other access protection. Circumventing such measures can constitute a separate violation of law, independent of any analysis of the resulting content.

Malware and harmful code: Content or files that contain viruses, worms, trojans, ransomware, spyware, or any other malicious or harmful code, or that are designed to disrupt, damage, disable, overburden, or gain unauthorized access to any system, network, data, or account.

Harassment and threats: Content that harasses, bullies, stalks, threatens, intimidates, or seeks to silence, exploit, or endanger any individual, including targeted abuse, doxxing or publishing another person's private or identifying information without consent, and incitement of others to engage in such conduct.

Hateful content: Content that promotes, incites, or condones hatred, harassment, discrimination, denigration, or violence against individuals or groups on the basis of race, ethnicity, national origin, religion, disability, disease, age, sex, gender, gender identity, sexual orientation, immigration status, or any other characteristic associated with systemic discrimination or marginalization.

Adult and restricted content for publishing: When using the Service to publish to a connected platform, content that violates that destination platform's content standards, including adult or sexually explicit content, content promoting gambling, and content selling or marketing tobacco or alcohol to minors, where such content is prohibited by the destination platform's own community standards or rules.

Deceptive and harmful content: Content that is fraudulent, deceptive, or designed to mislead, including phishing, impersonation of any person or entity, false or misleading endorsements, and content that misrepresents the source, sponsorship, or affiliation of the content.

4. Prohibited Conduct

You must not engage in any of the following conduct in connection with the Service.

Spam and platform manipulation: Using the Service to send spam, post identical or substantially similar content across multiple accounts, engage in platform manipulation, or perform bulk, aggressive, automated, or repetitive actions that violate the automation, anti-spam, or platform-manipulation rules of any destination platform. When the Service performs write actions on your behalf (for example, posting, scheduling, or publishing content), those actions must comply with each destination platform's automation rules, including prohibitions on bulk, aggressive, or spammy behavior and on duplicative cross-account content.

Scraping, crawling, and stream-ripping: Scraping, crawling, spidering, harvesting, or extracting data or content from YouTube, X (Twitter), Meta or Instagram or Threads or Facebook, TikTok, LinkedIn, or any other platform outside of that platform's official application programming interfaces; stream-ripping or downloading protected media; and using the Service to circumvent, bypass, or defeat any access control, rate limit, encryption, or technological protection measure of any platform. The Service's analytics and Knowledge Base capabilities rely exclusively on official APIs, and you may not use the Service to perform, request, or facilitate scraping or stream-ripping.

Circumventing platform terms: Using the Service to violate, circumvent, or evade the terms of service, developer terms, community guidelines, automation rules, display requirements, brand guidelines, or other policies of YouTube, X (Twitter), Meta or Instagram or Threads or Facebook, TikTok, LinkedIn, or any other third-party platform whose services are reached through the Service.

API and rate-limit abuse: Exceeding or circumventing the rate limits, quotas, or access limitations of the Service or of any connected platform's API; reverse engineering, decompiling, disassembling, or attempting to derive the source code of the Service or any connected platform's API, except to the extent this restriction is prohibited by applicable law; and re-identifying, de-anonymizing, or reverse engineering any data made available through a platform.

Reverse engineering and tampering with HIVEMIND YT software: Reverse engineering, decompiling, disassembling, extracting, copying, repackaging, or redistributing the HIVEMIND YT desktop application, its local ingestion pipeline, or any of their components, or attempting to derive their source code, orchestration, algorithms, or non-public interfaces, except, and only to the extent, this restriction cannot lawfully be prohibited under applicable law. The open-source components distributed with the desktop application remain governed by their own licenses, and this restriction does not limit any right you have under those licenses. This rule mirrors the End User License Agreement.

Competing use of HIVEMIND YT software: Using the HIVEMIND YT desktop application, its local ingestion pipeline, or the output, structure, or observed behavior of either, to design, build, train, or operate a product, service, model, or dataset that competes with HIVEMIND YT, or to perform bulk, automated, or systematic extraction of data or media on behalf of any third party or for resale. This rule mirrors the End User License Agreement.

Impermissible secondary uses of platform data: Selling, licensing, sublicensing, or transferring data obtained through a connected platform's API; building or augmenting profiles of individuals without valid consent; using platform content to train foundation or artificial intelligence models where prohibited by the platform; deriving non-public user information; or creating a product or service that competes with a platform in violation of that platform's terms.

Unauthorized branding on user content: Superimposing or adding any brand name, logo, watermark, or promotional branding onto content you submit for publication, except where the destination platform expressly permits it in writing.

Unauthorized access and security violations: Accessing or attempting to access any account, system, data, or area of the Service that you are not authorized to access; probing, scanning, or testing the vulnerability of the Service or any related system or network; interfering with or disrupting the integrity or performance of the Service; bypassing any access or authentication controls; and using another person's credentials or sharing your credentials in violation of the Terms of Service.

Service abuse and resource overuse: Using the Service in a manner that imposes an unreasonable or disproportionately large load on our infrastructure or that of our providers; using automated means to access the Service except through the public developer API as permitted; and using the render or export features to process media you do not have the necessary rights to use.

Misuse of API keys and credentials: If you supply your own artificial intelligence or YouTube API keys (BYOK) for use with the Service, you are solely responsible for those keys, for any usage and charges incurred under them, and for ensuring that your use complies with the issuing provider's terms. You must not supply keys you are not authorized to use or use BYOK functionality to evade quotas, rate limits, or platform restrictions. The features that run on your own keys include Knowledge Base creation and ingestion, Knowledge Base chat and other retrieval-augmented answers, Deep Dive, Retention Lab, Sponsor Insights, trend alerts, the Writers' Room and other brainstorm features, the Creative Agency features, gear extraction and product discovery, and storyboard, character, and sound-effect generation; your provider bills you directly for those, and HIVEMIND YT LLC does not reimburse those charges. The Pulse Analytics suite, including Create Clips moment detection, and the anonymous guest demo run on our own credentials, subject to the spending ceilings we set. Section 7 of the Terms of Service states in full which features run on your credentials and which run on ours.

Unlawful and prohibited business use: Using the Service for any unlawful purpose, for prohibited or restricted business activities, or in a manner that would cause HIVEMIND YT LLC or its payment processor to violate any applicable law or card network rule.

Misrepresenting affiliation: Implying or asserting any endorsement, sponsorship, partnership, certification, or affiliation with YouTube, Google, X (Twitter), Meta, Facebook, Instagram, Threads, TikTok, LinkedIn, or any other platform or provider, where no such relationship exists.

5. Official APIs Only and No Stream-Ripping

HIVEMIND YT LLC accesses YouTube, YouTube Analytics, and other third-party platform data exclusively through those platforms' official, authorized application programming interfaces. The Service's analytics, Video Intelligence, and Knowledge Base ingestion paths use 100 percent official Google and YouTube APIs. We do not use scrapers, and we do not use stream-ripping, to obtain platform content for these features.

You likewise must not use the Service to upload, submit, ingest, process, publish, or distribute any content that was stream-ripped, scraped, or otherwise obtained without authorization or by circumventing a platform's technological protection measures. The render worker and export features are intended to process only media that you have uploaded yourself or for which you hold all necessary rights, and the Service does not circumvent technological protection measures or rip protected streams.

Where the Service ingests content from your own YouTube channel using credentials that you authorize (for example, captions or analytics for a channel you own and control), such access is performed only with your authorization and only through official APIs in a manner consistent with the applicable platform terms. Nothing in the Service is intended to enable, and you may not use the Service to perform, unauthorized downloading, stream-ripping, or scraping of any platform's content.

When you use the Service to upload content to a platform through that platform's API, you certify that the content you upload complies with that platform's terms of service and community guidelines, and you remain solely responsible for the content you choose to upload and publish.

6. Publishing to Third-Party Platforms

The Service can publish and schedule content to third-party social platforms, including Meta or Instagram or Threads or Facebook, TikTok, X (Twitter), and LinkedIn, only on your behalf and at your direction. You retain responsibility for the content you create and choose to publish, and content is transmitted to a destination platform only after you expressly direct and authorize the upload through your own valid platform authorization.

You represent and warrant that you hold all rights, consents, permissions, and licenses necessary in any content you submit for publication. You must comply with the rules of each destination platform to which you publish, which are incorporated by reference into this Policy, including each platform's content standards, automation rules, and brand and display requirements. You must not use the Service to publish content that any connected platform's community standards forbid.

The names, logos, and marks of YouTube, X (Twitter), Meta, Facebook, Instagram, Threads, TikTok, and LinkedIn are the property of their respective owners. The Service uses each platform's brand features only under the limited license that the platform grants and only to identify the integration or to identify the platform as the source of its content. You must not use those marks in a way that implies endorsement, sponsorship, partnership, or affiliation, and you must not create derivative works of those marks.

Your access to and ability to publish through any platform is subject to that platform's own terms and may be rate-limited, throttled, suspended, or terminated by the platform at any time. We pass those constraints through to you, and we are not responsible for a platform's availability, enforcement actions, content moderation decisions, suspensions, terminations, downtime, or data loss. Your relationship with each platform is governed by that platform's own terms, directly between you and that platform.

7. Enforcement

We may investigate any suspected or actual violation of this Policy. To the maximum extent permitted by law, we reserve the right, in our sole discretion and with or without prior notice, to take any action we deem appropriate in response to a violation or suspected violation, including the actions described below. We are not obligated to take any particular action, and our decision not to act in one instance does not waive our right to act in another.

Warning: We may issue a warning identifying the conduct or content at issue and requiring you to correct it within a stated period.

Content removal and feature restriction: We may remove, disable access to, refuse to publish, or quarantine offending content, and we may suspend, throttle, or restrict your access to specific features, including publishing, render or export, API access, Knowledge Base ingestion, or Community Portal participation, including where required to comply with a connected platform's terms or an enforcement request from a platform.

Suspension: We may suspend your account or your access to all or part of the Service, temporarily or pending the outcome of an investigation.

Termination: We may terminate your account, revoke your access codes and credentials, and discontinue your use of the Service, including for repeat infringement of intellectual property rights and for serious or repeated violations of this Policy. For prohibited content involving the sexual exploitation of children, termination is immediate and without notice.

Reporting to authorities and platforms: Where required by applicable law, or where we determine it is appropriate to protect the safety of any person or to comply with legal process, we may report violations, preserve and disclose relevant records and account information to law enforcement and other authorities, and notify or cooperate with affected third-party platforms. We will report child sexual abuse material to NCMEC and to law enforcement as required by law.

Cooperation and audits: You agree to cooperate with our reasonable requests to verify compliance with this Policy, including proof-of-compliance or audit demands that a connected platform may require us to pass through to you.

No liability and indemnification: We are not liable to you for any action taken in good-faith enforcement of this Policy, including content removal, suspension, or termination. You agree to defend and hold HIVEMIND YT LLC harmless from claims arising out of your content, your violation of this Policy, or your misuse of the Service or of any connected platform, as further provided in the Terms of Service. Enforcement of this Policy is in addition to, and does not limit, any other rights or remedies available to HIVEMIND YT LLC at law, in equity, or under the Terms of Service.

8. How to Report Abuse

If you become aware of any content or conduct on the Service that you believe violates this Policy, please report it promptly to us at contact@hivemind.yt. Written notices may also be directed to HIVEMIND YT LLC through its registered agent on file with the California Secretary of State.

To help us respond effectively, please include a description of the content or conduct at issue, the location or identifier where it can be found on the Service (such as a link, username, or other reference), the reason you believe it violates this Policy, and your contact information so we can follow up if needed.

Reports concerning the sexual exploitation of children, imminent threats to safety, or other emergencies should be reported to us immediately at contact@hivemind.yt and, where appropriate, to the relevant law enforcement authorities. Claims of copyright infringement are handled under our separate DMCA notice-and-takedown process and should be submitted as described in that policy. We review reports we receive and take the action we determine to be appropriate under this Policy, but submitting a report does not guarantee any particular outcome.

9. Changes to This Policy

HIVEMIND YT LLC may update or modify this Policy from time to time to reflect changes in the Service, our practices, applicable law, or the requirements of the third-party platforms and providers we integrate with. When we make changes, we will revise the date shown as last updated at the top of this Policy and, where appropriate, provide additional notice through the Service.

Changes are effective when posted unless we state otherwise. Your continued access to or use of the Service after a change to this Policy becomes effective constitutes your acceptance of the revised Policy. If you do not agree to the revised Policy, you must stop using the Service. We encourage you to review this Policy periodically.

10. Governing Law and Contact

This Policy and any dispute arising out of or relating to it are governed by the laws of the State of California, without regard to its conflict-of-laws principles, and are subject to the dispute-resolution provisions of the Terms of Service, including binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association, venue in California, and the waiver of class actions, in each case as set out in the Terms of Service.
